RETAIL INTERNET BANKING (RIB) TERMS AND CONDITIONS

 
A. RETAIL INTERNET BANKING
1. The UCPB's (the "Bank) Retail Internet Banking facility can be accessed through any of the following:
a. Internet-based (access via personal computer)
b. Wireless Application Protocol (WAP) (access via WAP-enabled cellular phones)
2. Any service fees collected by any internet or mobile phone service company for access of the Retail Internet Banking through internet or mobile phone service shall be paid by the client.
3. The following transactions shall be available under the Retail Internet Banking facility are as follows:
a. Account Balance Inquiry (Peso CA/SA, FCDU SA, UCPB Mastercard, Loan, Insurance)
b. Fund Transfer (Peso CA/SA and FCDU SA)
c. Debit Bills Payment
d. Inter-bank Fund Transfer (Peso CA/SA)
e. Request Hold of ATM Card
f. Stop Payment Order (SPO)
g. Checkbook Request
h. Statement of Account Request
i. Account Transaction Inquiry
j. Loans Calculator
k. Bank Mail
l. Personalization of Account Names
m. Account Notification Service
n. such other types of retail internet banking services as the Bank may from time to time introduce or include
4. Only Peso CA/SA, FCDU SA, UCPB Mastercard, Loan or Insurance account(s) specifically enrolled by the client shall be provided with the Retail Internet Banking facility. Additional account(s) has/have to be enrolled by the client to gain access to the RIB by enrolling the accounts on-line or through the corresponding UCPB maintaining branch which shall be subject to verification of the Bank.
5. The Retail Internet Banking facilities shall be available 24 hours a day, 7 days a week, except when the facility is on off-line condition for any reason. Retail Internet Banking facility shall depend on the availability of line connection of the internet or mobile phone company.
 
B. ACCESS TO RETAIL INTERNET BANKING
1. The Bank shall provide the client with instructions on how to use the services of the Retail Internet Banking upon enrollment. It is understood that the Bank shall entertain requests for the above-enumerated services relative only to the client's deposit accounts.
2. The client can access any of his enrolled accounts with the use of his User ID and Password. For joint "or" accounts, User ID(s) and Password(s) shall be separately declared/assigned by the client.
3. The User ID(s) and Password(s) shall only be known to the client. The client may at his option change his User ID(s) and Password(s) through the Retail Internet Banking anytime he deems it necessary or based on his own discretion. It shall be the sole responsibility of the client to maintain the confidentiality of his User ID(s) and Password(s).
4. The client shall be responsible for all transactions made in his deposit/linked accounts through the use of his User ID(s) and Password(s).
 
C. ACCOUNT BALANCE INQUIRY
1. The following accounts can be inquired through the Retail Internet Banking:
a. Peso Savings and Current deposit accounts
b. FCDU Savings deposit account
c. UCPB Mastercard account
d. Loan account
e. Insurance
2. The client can inquire as of the date and time of inquiry his current, available and for clearing balances for each of his enrolled Peso savings/current and FCDU savings account(s) as well as his outstanding balances or any other information regarding his other accounts with the Bank as allowed through the Retail Internet Banking facility.
 
D. FUND TRANSFERS
1. The client can transfer funds on current date or on a future date specified by the client.
2. Current-dated fund transfer shall be subject to the availability of cleared balance of client's deposit account while Future-Dated fund transfer on the specified date of transfer, not on the date the future dated fund transfer was issued.
3. Cancellation of future fund transfers can be done through the Retail Internet Banking-Fund Transfer facility. The client can verify cancellation of future-dated fund transfer through the Account Transaction Inquiry in the RIB.
4. Fund Transfers shall be allowed between accounts of the same currency for Peso savings/current or FCDU savings account(s). Peso CA/SA transfers shall be allowed between accounts maintained in the same branch or with another branch, while FCDU SA transfers shall be allowed only between accounts maintained in the same branch.
5. In case of erroneous fund transfer, the client shall report the problem to the maintaining branch, ATM Center or Customer Relations Center within 24 hours or on the next banking day after the fund transfer was made.
6. For joint "or" accounts, whenever one of the depositors effects fund transfer/drawing against the account, it is understood that the act is being done on the basis of the client(s)' continuing declaration and representation that all co-depositors are still living as of the date of the transfer. It is likewise understood that the client shall hold the Bank free and harmless from any liability, claims or damages resulting from it's reliance on such declaration and representation. Each and everyone of the depositor or co-depositors shall be jointly and severally liable for all fund transfers/drawings, regardless of who initiated the fund transfer.
 
E. DEBIT BILLS PAYMENT
1. Upon enrollment in the debit bills payment facility, the client (hereinafter referred to as the "ENROLLED SUBSCRIBER") hereby authorizes the Bank to debit his deposit account for credit to the concerned Institution's account.
2. The ENROLLED SUBSCRIBER may not be the owner of the subscriber's account number with the Institution as stated in the institution's billing invoice.
3. The ENROLLED SUBSCRIBER shall be liable for amounts debited from his account through the use of the Retail Internet Banking. In case of insufficient funds, the payment request shall be automatically cancelled by the Bank.
4. The ENROLLED SUBSCRIBER shall immediately notify the Bank of any discrepancy/ies in the resulting balance after the debit bills payment transaction.
5. The ENROLLED SUBSCRIBER shall hold the Bank free and harmless from any liability, claims or damages in connection with or resulting from payments made to the Institution concerned, specifically, for past due accounts or partial payments made.
6. The ENROLLED SUBSCRIBER agrees that the reference number given by the Bank at the time of payment through the Retail Internet Banking shall serve as evidence of payment.
7. It shall be the responsibility of the Institution to send an official receipt to the ENROLLED SUBSCRIBER.
8. The ENROLLED SUBSCRIBER agrees that any and all discrepancies/protests relative to the billings shall be taken up by the ENROLLED SUBSCRIBER directly with the Institution.
9. The effectivity date of payments made using this facility shall be on the next banking day.
10. The ENROLLED SUBSCRIBER or the Bank may terminate this agreement anytime upon written notice to the other.
 
F. INTER-BANK FUND TRANSFER (PESO CA/SA)
1. The client may transfer funds from any of its enrolled UCPB Bank account(s) to its own or anyone else's bank account in another bank. Only peso savings/current accounts shall be eligible for Inter-bank fund transfer.
2. If the fund transfer instruction (Payment Order Form) was received by the Bank before the Bank's specified daily cut-off time, the transfer of funds shall take effect on the next banking day. Otherwise, the transfer of funds will take effect on the 2nd banking day from the time the fund transfer instruction was received by the Bank.
3. This inter-bank fund transfer is subject to service fees and charges published in the Bank's website. In case an erroneous fund transfer is made by the client, the Bank shall, on best effort, assist the client in rectifying the error by allowing the client to fill up and submit an Amendment/Reclamation form available under the Inter-bank Fund Transfer menu on this website; PROVIDED, however, that the erroneous fund transfer instruction is not over two (2) day's old. This assistance of the Bank should not be construed as a guarantee by the Bank that a return of funds or an amendment of an incorrect account number will be carried out as this will largely depend on factors outside of the Bank's control, such as, but not limited to, the availability and willingness of the other bank's holder of the account to authorize a debit of his/her account for credit back to the requesting Bank's client; the sufficiency of the funds of the other bank's account, etc.
4. For joint "or" accounts, whenever one of the depositors makes a fund transfer/drawing against the account, it is understood that such transfer is being done on the basis of the client(s)' continuing declaration and representation that all co-depositors are still living as of the date of the transfer. It is likewise understood that the client shall hold the Bank free and harmless from any liability, claims or damages resulting from its reliance on such declaration and representation. Each of the depositor or co-depositors shall be jointly and severally liable for all fund transfers/drawings, regardless of who initiated the fund transfer.
 
G. REQUEST HOLD OF ATM CARD
1. The client agrees to immediately request hold of lost/stolen ATM card via the Retail Internet Banking. The Bank shall not be held liable for any consequences/damages resulting from the use of the request hold of ATM card facility prior to receipt by the Bank of request from the client.
 
H. STOP PAYMENT ORDER (SPO)
1. The Stop Payment Order shall be effected through the Retail Internet Banking if the subject check has not yet been negotiated as of the date and time of request for SPO.
2. For joint "or" accounts, it is understood that the co-depositor has full knowledge of the SPO requested by his co-depositor through the Bank's Retail Internet Banking.
3. Return of check for reason of Stop Payment shall be subjected to the corresponding service charges under the existing PCHC Rule Book and Bank's internal guidelines on service charges and fees.
4. Cancellation of the SPO can only be made upon submission of a duly signed written request by the client who requested for the SPO at his maintaining branch.
5. The client hereby agrees:
a. to hold the Bank free and harmless from any liability, claims or damages in connection with or resulting the use of the SPO facility.
b. to indemnify the Bank for any loss, expense or cost that it shall incur as a result of the non-payment of the check subject of SPO
c. to hold the Bank free and harmless from any liability, claims or damages on account of payment of the aforementioned check, contrary to the request/SPO, if the same occurred through inadvertence, accident or mistake; and
d. to promptly notify the Bank in writing the date and time when said check is recovered or if for any other reason the SPO shall be cancelled.
 
I. CHECKBOOK REQUEST
1. Checkbooks requested through the Retail Internet Banking shall be for pick-up at the client's maintaining branch after two (2) weeks from date of request. A letter of authorization is required if such checkbook(s) shall be picked up by a representative.
2. The client's current/PERKS account shall be debited for the cost of checkbook(s) without need of further demand, notice or consent. Any additional cost such as increase in printing cost and/or documentary stamps tax shall be charged to the client.
 
J. STATEMENT OF ACCOUNT REQUEST
1. The client can request his Statement of Account for current and previous for any of his enrolled accounts. The Statement of Account can be picked-up by the client or through e-mail or via fax.
 
K. ACCOUNT TRANSACTION INQUIRY
1. The client can view on-line maximum of 10 transactions per screen as specified by the client on any of his enrolled accounts in the Retail Internet Banking.
 
L. BANK MAIL
1. The client may communicate through the Bank Mail complaints or any other concerns, however, he must not rely only on this way of communicating serious matters such as reporting of unauthorized transaction in any of his accounts.
2. The Bank may respond to the client through the Bank Mail with regard to new Bank products and services as well as any concern related to UCPB services.
 
M. PERSONALIZATION
1. The client can modify his personal information in the Retail Internet Banking facility or change his User ID and/or Password.
2. Any modifications done by the client in the client information file shall not replace existing client records on Bank file. Change of necessary information on the client's Bank records shall require validation by the client's maintaining branch.
 
N. OTHER RETAIL INTERNET BANKING SERVICES
1. The client can do other banking transactions through other RIB facilities such as Account Notification, Loans Calculator, Loan services application/inquiry and enrollment procedures inquiry.
 
O. GENERAL AGREEMENT
1. Enrollment in the Retail Internet Banking shall take effect upon receipt by the client of the Bank's confirmation of the activation of the enrolled accounts.
2. The Bank reserves the right to cancel client's access privilege to the Bank's Retail Internet Banking if in its opinion the account is improperly handled.
3. The client shall hold the Bank and/or any of its officers or representatives free and harmless from any delay, loss, liability, demand or claim of whatever nature due to any error occurring in connection with or resulting from the use of the Retail Internet Banking, including but not limited to computer error, computer off-line or telephone and/or mobile phone line interruption, or any other cause not reasonably within the Bank's control. The client waives all rights of action against the Bank in relation thereto.
4. Any and all transactions coursed through any of the above-enumerated services corresponding to the client's deposit account(s) shall be binding and conclusive upon the client. For joint "or" accounts, it is understood that all transactions done through any of the above-enumerated services are binding on the co-depositors irrespective of who initiated the transaction. As such, the client(s) shall be responsible for all consequences of such transactions initiated relative to his/their corresponding deposit account(s).
5. Requests for stop of a check and checkbook re-order shall be subject to appropriate charges pursuant to the Rules and Regulations Governing Establishment and Operation of Peso Demand Deposits. The Bank reserves the right to impose service fees and other reasonable charges pursuant to the Bank's standing policy/ies, and to change or amend the same upon prior notice to the client. For the purpose of collecting the above charges, the client authorizes the Bank to debit the corresponding amount of the charges from the client's deposit account(s).
6. The Bank may amend any time any of these terms and conditions as it may deem necessary for the best interest of both parties: provided, such amendments are not contrary to banking laws and regulations of the Bangko Sentral ng Pilipinas (BSP).
7. The Bank may terminate this Agreement at any time for whatever reason without need for prior notice to the client.
8. Other terms and conditions of the Bank applicable to either savings or current, ATM and Telebanking shall be deemed part and parcel of this agreement in so far as they are not inconsistent hereof.
